BROCKTON – A man has pleaded not guilty to a charge that he fatally shot a 26 year-old Brockton man in 2022, Plymouth County District Attorney Timothy J. Cruz has announced.
David K. Lynch, 24, was arraigned today from his hospital bed at Boston Medical Center on one count of Murder. He pleaded not guilty and was held without bail at the request of the Commonwealth.
At approximately 7:31 p.m. on November 2, 2022, Brockton Police and Brewster Emergency Medical Services responded to 19 West Park Street for a report of a person shot. Upon arrival, first responders located a male suffering from a gunshot wound to his right shoulder. The male victim was transported to Good Samaritan Hospital before he was medflighted to Boston Medical Center where he was pronounced dead. He was identified as 26 year-old John Depina.
Brockton Police contacted Massachusetts State Police troopers assigned to the Plymouth County District Attorney’s Office and an investigation commenced. Investigators reviewed surveillance video that showed a newer Nissan Altima with excessive window tint, stop in front of 19 West Park Street, and an argument ensued between Lynch and Depina. On the video, as the motor vehicle left the scene, Depina can be seen grabbing his right upper chest area.
Investigators contacted the Massachusetts Electronic Monitoring Program hotline and were advised that Lynch was currently on GPS monitoring with Massachusetts Probation Services. The agency detected Lynch’s GPS in the area of 19 West Park Street at the time of the shooting.
Police responded to Lynch’s last known address in Weymouth and observed a gray Nissan Altima with window tint, but Lynch was not located at that address. The last known location of Lynch’s GPS bracelet was 79 Brookeville Avenue in Brockton. Brockton Police responded to that area and found Lynch’s GPS bracelet discarded there.
Since the date of the homicide, police have been attempting to locate and arrest Lynch. Massachusetts State Police Violent Fugitive Apprehension Section added Lynch to their Most Wanted list.
Yesterday, Lynch was observed sitting in a BMW in a parking lot in Middleboro. As Troopers and Officers approached, Lynch rammed two police vehicles as he fled onto Route 44. The suspect was pursued for a short period of time until Troopers lost sight of the suspect vehicle. At approximately 3:05 p.m., Lynch’s vehicle struck another car at the intersection of Orchard and Warren streets in Raynham. The crash resulted in serious injuries to an occupant of that car. Following the crash, Lynch and his male passenger fled the scene on foot but were apprehended after a brief foot pursuit. The victim whose car was struck was transported to Good Samaritan Hospital in Brockton before being transferred to a Boston hospital for treatment.
Lynch was transported to Good Samaritan Hospital under police guard, before being taken to Boston Medical Center, where he remains hospitalized.
Lynch is next scheduled to appear in court on July 14.
