BROCKTON – A Brockton man was arraigned today on charges stemming from a fatal hit-and-run earlier this month, Plymouth County District Attorney Timothy J. Cruz has announced.

Dominick Leite, 30, is charged with Motor Vehicle Homicide by Negligent Operation and Leaving the Scene of Personal Injury or Death. He pleaded not guilty to the charges and was placed on $2,500 cash bail and ordered to stay away and have no contact with any witnesses in this case. The Commonwealth requested Leite be held on $5,000 cash bail.

On September 3, Massachusetts State Police were informed that a victim in a hit-and-run that occurred on August 31 had succumbed to his injuries at a local hospital. He was identified as 41-year-old Holden Depina. Preliminary investigation into the death found that shortly before 10 p.m. on the date of the incident a blue Mazda hit Depina while he was crossing Crescent Street in Brockton. A witness traveling on the roadway saw the vehicle leave the scene following the collision, and surveillance footage obtained by law enforcement showed the Mazda travel to a home later determined to be Leite’s residence.

Through investigative efforts, law enforcement located a blue 2015 Mazda 6 with damage consistent to the fatal incident at a local autobody shop. The vehicle — which investigators determined is registered to Leite — had been brought into the shop for repairs shortly after the incident on September 2. The phone number used to contact the autobody shop was also traced back to Leite by law enforcement.

Leite was arrested without incident at his home in Brockton on September 17. He is next scheduled to appear in court on October 17.
