Commonwealth Prevails In Appeal Of Child Rape Convictions

BROCKTON – The Massachusetts Appeals Court has affirmed the convictions  of a man charged with raping a female juvenile, Plymouth County District Attorney Timothy J. Cruz has announced.

On May 4, 2022, a jury found Scott McCaffrey, 56, guilty of five counts of Aggravated Rape of a Child, four counts of Indecent Assault and Battery on a Child Under 14, and one count each of Dissemination of Harmful Matter to a Minor and Lewd, Wanton and Lascivious Conduct. McCaffrey was sentenced to serve 15-18 years in State Prison with five years of probation from and after.

In January, 2020, a female juvenile reported to law enforcement that during 2014 and through 2015, she had been sexually assaulted on numerous occasions by McCaffrey. Abington Police conducted an investigation and a warrant issued for McCaffrey’s arrest. McCaffrey was tracked to an address in Florida where he was arrested by local police.

Today, in a published decision, the Appeals Court affirmed the defendant’s conviction.

“I hope that today’s Appeals Court decision reinforces the fact that justice was served for the victim in this horrific case,” DA Cruz said.

Assistant District Attorney Arne Hantson handled the case before the Appeals Court, while Assistant District Attorney Jeremy Beth Kusmin prosecuted the case.
