Brockton Man Sentenced To 15 To 18 Years In State Prison For Role In Fatal Drive-by Shooting

BROCKTON MAN SENTENCED TO 15 TO 18 YEARS IN STATE PRISON FOR ROLE IN FATAL DRIVE-BY SHOOTING

PLYMOUTH – A Brockton man pleaded guilty to a charge of murder today relating to a 2018 shooting incident, Plymouth County District Attorney Timothy J. Cruz has announced.

Andrew Tymek, 26, pleaded guilty to one count each of Murder, Assault by Means of a Deadly Weapon, Malicious Injury to a Motor Vehicle, Unlawful Possession of a Firearm, Unlawful Possession of a Loaded Firearm, and Unlawful Discharge of a Firearm within 500 Feet of a Building.

The charges stem from the June 8, 2018 drive-by shooting death of 21-year-old Anthony Baker in Brockton. Superior Court Judge William Sullivan sentenced Tymek to 15 to 18 years of incarceration in state prison.

Tymek and co-defendant Christopher Nogueira, 27, of Taunton were both charged in connection to the fatal incident. A Plymouth County jury found Nogueira not guilty on all charges related to the fatal shooting on November 27 in Brockton Superior Court.

Just after 6 p.m. on June 8, 2018, Brockton Police received multiple 911 calls for reports of a shooting on Arthur Street. Upon arrival at 10 Arthur Street, Brockton Police located Baker lying unresponsive in the street. Emergency medical personnel transported him to Good Samaritan Hospital in Brockton where he was pronounced deceased.

            Brockton Police contacted Massachusetts State Police detectives assigned to the Plymouth County District Attorney’s Office and a homicide investigation commenced. As part of the investigation, police learned that the victim and Tymek knew each other previously, and there was an ongoing feud between the men and their respective circle of acquaintances.

Second Assistant District Attorney Jennifer Sprague prosecuted Tymek’s case, which was investigated by State Police Detectives assigned to the Plymouth County District Attorney’s Office and Brockton Police.
