Everett Man Sentenced to 10 Years in State Prison for Sexual Assault on Girl

BROCKTON – An Everett man has been sentenced to State Prison after being found guilty of sexually abusing a girl, Plymouth County District Attorney Timothy J. Cruz has announced.

After a five-day trial, a jury deliberated for more than 12 hours before finding Javier Zuniga (DOB: 09/19/66) of Everett, guilty of Rape and Abuse of a Child Aggravated by Age Difference, four counts of Indecent Assault and Battery Under 14, two counts of Intimidation of a Witness, and one count each of Sexually Annoying and Accosting a Person of the Opposite Sex, Attempting to Commit Indecent Assault and Battery on a Child Under 14. Superior Court Judge Charles Hely sentenced Zuniga to serve 10 years to 10 and one day in State Prison on the charge of Rape and Abuse of a Child Aggravated by Age Difference, and five years to five years and one day on the two charges of Indecent Assault and Battery on a Child Under 14. That sentence is to be followed by five years of probation on the remaining charges, with the conditions that Zuniga have no contact with the victim and her mother, that he stay away from children under the age of 16, that he register as a sex offender, get required treatment and that he wear a GPS monitoring bracelet.

Zuniga was on trial for sexually abusing a family member when the child was between the ages of 5 and 12-years-old on numerous occasions during 2006-2007, while living with the child in Rockland. Zuniga was also found guilty of sexual assaulting the victim on numerous occasions from June through September 2013 while residing with the child in Plymouth.

Assistant District Attorney Mary Nguyen prosecuted the case, which was investigated by Plymouth Police and Rockland Police.
