BROCKTON – A Brockton man has been convicted of gun and drug charges and being an Armed Career Criminal, Plymouth County District Attorney Timothy J. Cruz has announced.
On August 26, 2019, after a four-day trial, a jury deliberated several hours before finding Allah Mallory (DOB: 10/23/76) of Brockton, guilty of Possession of a Firearm, Possession of Ammunition, Trafficking Heroin Over 100 Grams, Trafficking Cocaine Over 36 Grams, and Use of a Firearm While Committing a Felony. In a subsequent hearing for the enhanced penalties based on Mallory’s prior convictions, he was additionally convicted of two counts of the Armed Career Criminal III Enhancement for possessing the firearm and ammunition.
Today, Brockton Superior Court Judge Mark C. Gildea sentenced Mallory to serve a term of no less than 16 years and no more than 18 years in state prison. The Commonwealth recommended that Mallory serve 18-20 years in state prison, to be followed by a consecutive from and after sentence of five years to five years and a day.
After an investigation by Brockton Police into drug activity involving Mallory, on April 20, 2016, officers sought and obtained a search warrant for his third floor apartment at 933 Warren Avenue. Once inside the residence, officers located a large, unlocked safe inside one of the bedrooms. Inside the safe, police found a .357 Smith and Wesson revolver loaded with three rounds. Mallory was placed under arrest. Police additionally seized over 100 grams of heroin, over 36 grams of cocaine 41 grams of crack cocaine, cash and drug distribution paraphernalia.
During the enhancement penalty phase of the trial, the jury heard testimony from victims and witnesses from the defendant’s prior violent cases that recounted facts stemming from his convictions of assault and battery, as well as assault and battery by means of a dangerous weapon.
Mallory has been on the District Attorney’s “Safety First” list over the years, which documents and monitors repeat and habitual domestic violence offenders that come through the court system. “A reading of police reports and grand jury minutes establishes that this defendant has been nothing less than a menace to the city of Brockton since the early 1990’s, focusing his actions on trafficking drugs and committing countless acts of domestic violence,” DA Cruz said. “We are grateful to the US Attorney’s Office, the US Marshal’s Service and Brockton Police for their assistance in securing the defendant’s daily attendance for trial. Prosecutions like this case send a strong message that we all share a common goal and will be not be deterred from our mission of trying to keep the streets safe.”
Mallory, who was previously convicted of Possession with the Intent to Distribute Cocaine within a School Zone out of Brockton Superior Court, had his State Prison sentence vacated in the wake of actions by State Drug Lab chemist Annie Dookhan.
In August, 2018, while out on $50,000 cash bail, Mallory was re-arrested on a cocaine distribution charge as part of the Department of Justice’s Project Safe Neighborhood Initiative sweep done in Brockton and Boston. That case against Mallory is pending in United States District Court in Boston.
The case was prosecuted by Assistant District Attorney Brian Fahy and was investigated by Brockton Police.
