BROCKTON – The Massachusetts Appeals Court has affirmed the convictions of an Everett man found guilty of child rape charges, Plymouth County District Attorney Timothy J. Cruz announced today.
In November, 2017, after a three-day trial in Plymouth Superior Court, a jury deliberated three hours before convicting David A. Torrey, now 58, of 12 counts of Rape of a Child by Force and one count of Dissemination of Harmful Matter to a Minor. Torrey was sentenced to serve no more than 12 years, no less than 10 years at MCI-Cedar Junction to be followed by lifetime probation from and after.
The charges followed an investigation by Kingston Police after they were contacted on April 29, 2014 by an adult victim who came forward to report a long history of past abuse by Torrey.
Torrey appealed his conviction to the Massachusetts Appeals Court, claiming trial counsel was ineffective because he failed to object to certain testimony from the victim and for other various tactical decisions. Late Friday in an unpublished decision, the Appeals Court rejected Torrey’s claims.
The case was prosecuted by Assistant District Attorney Shanan Buckingham and the Appeals Court case was handled by Assistant District Attorney Audrey Anderson.
